THE COUNTY CLERK'S OFFICE IS NOT REQUIRED BY LAW TO PERFORM ANY SEARCHES INCLUDING GENEALOGY OTHER THAN A FEDERAL TAX LIEN SEARCH. YOU MUST COME TO THE COUNTY CLERK'S OFFICE TO SEARCH RECORDS NOT ON THE WEBSITE.

Attorney General Opinion WW-607 (1959) Summary states: “The County Clerk has no duty to search the records under his control and guarantee the correctness thereof.”

WE ARE NOT ATTORNEYS and cannot give any legal advice on what should be filed. We also are not permitted to prepare any documents for filing, per Government Code 81.101.

Documents received after 4 p.m. will be filed the next business day.

Why E-Record?

For the Clerk's office, the answer is easy – efficiency. E-Recording insures direct filing without waiting in lines; insures that your record is made available online faster, and no last minute rush to the Clerk's office. If it is more efficient for us, it is more efficient for filers.

Filing electronically and using electronic documents provide the following advantages as well as many others:

1. Reduces costs of paper and postage.
2. Safer transmittal of documents to the Clerk's office.
3. The Clerk's office becomes transparent, the submitter knows exactly when the document is submitted and filed.
4. If there is any problem with a document that prevents it from being filed, the Clerk's office will return the document to the submitter electronically with a specific reason given as to why the document could not be filed.

Who Can E-Record?

Texas Local Government Code, Sec. 195.003, limits the authorization to electronically file documents to the following entities:

• An attorney licensed in this state
• A bank, savings and loan association, savings bank, or credit union doing business under laws of the United States or this state
• A federally chartered lend institution, a federal government sponsored entity, an instrumentality of the federal government, or a person approved as a mortgagee by the United States to make federally insured loans
• A person licensed to make regulated loans in this state
• A title insurance company or title insurance agent licensed to do business in this state
• An agency of this state
• Municipal Clerk

RE: MARK AND BRAND RENEWAL
Texas Agricultural Code 144.044

The re-registration period for marks/brands on cattle, horses, etc. begins August 31, 2021 and ends February 28, 2022.  A person who does not renew their brand/mark during this period forfeits their legal right to that brand/mark.   You must re-register your brand/mark in person at the Red River County Clerk’s Office, 200 N. Walnut Street, Clarksville, Texas. The fee is $25 plus $5 per each additional location. The same brand may be registered in the same county as long as the location on the animal is different.
